Terms and Conditions

The following terminology applies to these terms and conditions: ‘Abigail Designs’, ‘ourselves’,

‘we’, ‘our’ and ‘us’ refers to Abigail Designs. ‘The client’, ‘you’ and ‘your’ refers to you, the reader.

 

By agreeing to use Abigail Designs’ services in writing via

email, you agree to the following terms and conditions:

 

1. Once you have chosen your package(s) and/or service(s) and have confirmed via email that you wish to proceed, Abigail Designs will send you an invoice by email stating that 50% of the job quote that you have agreed to will be required to be paid by you to Abigail Designs. Upon payment through bank transfer will

you then secure your booking with Abigail Designs and the agreed to outlined process will proceed. The outstanding payment amount is to be paid once the files have been signed off by you via email, and only

once this payment has been received will the files be sent over to you.

2. Upon payment of your first invoice, the outstanding invoice must be paid within 30 days of its issue date which will be once we have sent the agreed deliverables. If you do not make your payment within this timeframe, a charge of £100 a day will incur starting from the 31st day of the issue date and continuing until full payment has been made. After 60 days of the issue date upon failure to make full payment, legal action will be taken whereby the client is also responsible for legal fees necessitated by lateness and failure of full payment to Abigail Designs.

 

3. No refunds are offered by Abigail Designs after payment has been made by the client.

 

4. Abigail Designs offers 3 rounds of amendments as standard per project unless otherwise stated

in the proposal sent to the client. If you request and agree to additional amendments, an extra fee

will incur which will be outlined by email.

 

5. Abigail Designs will deliver files to you through WeTransfer and we will explain to you how to download your files through this platform by email. Upon delivery, it is your responsibility to download and back up the files sent to you. You may request for the files to be resent however please note that after 5 weeks from the date

of the files being sent to you we have no obligation to retain or resend your files.

 

6. All design work created by Abigail Designs remains the intellectual property of Abigail Designs. Upon full payment, the client will have full ownership rights to the final design files, excluding any disused designs or concepts. Ownership rights are non-transferable and remain the property of the client.

 

7. Abigail Designs will communicate with you regularly and it is your responsibility to provide prompt and accurate feedback in order to meet project deadlines.

 

8. Abigail Designs respects the confidentiality of client information and will not disclose any information without the client’s consent.

 

9. Abigail Designs will not be held liable for any damages or losses incurred by the client or any third party resulting from the use or misuse of the project.

 

10. Abigail Designs reserves the right to modify or update these terms and conditions at any time without

prior notice. It is the client's responsibility to review these terms and conditions for any changes.

 

By agreeing to use Abigail Designs’ services in writing via email, you acknowledge

that you have read, understood, and agreed to these terms and conditions. If you
